To avoid this charge the driver must remain on the scene until he has exchanged contact information (name, address, phone, driver’s license, registration, etc.) with the owner of the damaged property, and police are notified.

Injury or Death

  • Where someone is injured and the driver willfully flees the scene of the accident, the offense is a third-degree felony and a fine up to $5000 and up to 5 years in jail. Where someone is killed in the accident the driver fleeing the scene faces a felony of the first degree and an up to $10,000 fine and 30 years in jail. To avoid these charges the driver again must remain on the scene until he has exchanged contact information (name, address, phone, driver’s license, registration, etc.) and police are notified.
